FAQ for Transfer of Agreement from CMEGIMD to CME Inc.

General

1. Why am I getting a transfer notification letter regarding my Agreement?

a. CMEGIMD is transferring its rights and obligations under the Agreement to CME Inc. per clause 13.1.

2. What does this mean to me, for my license, for my account?

a. As of 1 January 2016 your Agreement is with CME Inc., regardless of the location of your operations and customers. All rights licensed to you under the Agreement are granted by CME Inc.

3. Will there be changes to my invoices?

a. No, Customers who are currently invoiced by CME Inc. will not be affected

b. Yes, Customers who were previously invoiced by CMEGIMD will now be invoiced by CME Inc.

Billing, Tax, Payments

4. Why am I being billed by CME Inc. instead of CMEGIMD?

a. CMEGIMD transferred its rights and obligations to CME Inc.

5. Why am I not being assessed VAT on my invoice any longer?

a. CME Inc. is not required to charge VAT. However, you may wish to consider whether you are required to self-assess for VAT (or similar taxes) in your local jurisdiction (please seek your own tax counsel if you are unsure on this point).

6. Why am I now being charged sales tax?

a. You are being charged sales tax because you have Subscribers located in jurisdictions in the United States of America where CME Inc. has a tax collection requirement pursuant to state tax laws.CME Inc. collects sales tax in multiple jurisdictions pursuant to the state and local tax laws of those jurisdictions (primarily NY and NJ).Please note that various state and local tax laws may require purchasers to remit sales, use, or other taxes directly to the taxing jurisdictions.Please contact your state and local tax advisor if you have additional questions regarding your state and local tax obligations.

7. I believe my firm is exempt from sales tax, why am I still being charged?

a. Please provide a properly completed and executed Tax Certificate of Resale or Exemption for the applicable taxing jurisdiction.  (Please contact your state and local tax advisor if you have questions regarding applicable exemption certificates.)Submit completed form to marketdata@cmegroup.com , marketdataemea@cmegroup.com or marketdataapac@cmegroup.com

If you have already completed a Tax Certificate Exemption, please login to CME DataPoint and navigate to “My Account → Account Profile → Tax Exemption Certificate(s) we have on file” to verify that CME Group has your exemption form on file. If you are unable to locate a previously submitted exemption form, please contact your CME Account Manager or use the email aliases provided above. 

8. Why are sales taxes charged on some, but not all Subscriber locations?

a. CME Inc. collects sales tax in multiple jurisdictions pursuant to the state and local tax laws of those jurisdictions.Sales tax is determined based on the Subscriber’s location you provide to CME Inc. through CME DataPoint.Please note that various state and local tax laws may require purchasers to remit sales, use or other taxes directly to the taxing jurisdictions.Please contact your state and local tax advisor if you have additional questions regarding your state and local tax obligations.

9. Why am I getting two statements?

a. If you previously received invoices from CME Group International Market Data Limited and you have an open balance, you will continue to receive a statement until that balance is paid in full.

Moving forward for 2016, you will also receive a statement from CME Inc. for invoices issued by CME Inc.

10. Do remittance instructions change, due to the Agreement transfer and change in billing entity?

a. No, payments should be sent to the same location as noted on the invoices you receive from CME Inc.

11. Why do I still have an open balance on CME Group International Market Data Ltd (CMEGIMD)?

a. Invoices billed by CMEGIMD will remain on your CMEGIMD balance until they are paid in full.They will not be transferred.

12. How can I find my outstanding balance on CMEGIMD within DataPoint?

a. In CME DataPoint, navigate to Invoicing and Payment → Account Balance. Select CMEG International MktData Ltd to view your outstanding balance.
