FINDINGS:
Pursuant to an offer of settlement in which Alex Tomasik (“Tomasik”) neither admitted nor denied the rule violation upon which the penalty is based, on April 4, 2012, a Panel of the CME Business Conduct Committee found that on
April 19, 2010, Tomasik executed trades on the Globex electronic trading platform in a user defined covered options spread in which he entered four iceberg orders selling in quantities of one to four contracts totaling 431 contracts in the June 2010 Eurodollar 9950 put options which caused an under allocation of futures contracts that should have been associated with the covered instrument. As a result, the Panel found that Tomasik violated CME Rule 432.T.
PENALTY:
In accordance with the terms of the settlement offer, the Panel fined Tomasik $15,000.
