      LEGACY CBOT RULE  VIOLATIONS:

      432.L.1 (General Offenses)
      To fail to appear before the Board, Exchange Staff, or any investigative or hearing committee at a duly convened hearing or in connection with any investigation.

      618. (Satisfaction of Award)
      In the absence of any request to correct an award, the award must be satisfied within fifteen days of receipt of the notice of decision. Any party directed to pay an award shall submit payment directly to the person receiving the award and shall also submit evidence of such payment to the Market Regulation Department.

       

      FINDINGS:

      After the Chairman of the Business Conduct Committee found that the charges against Rodriguez were deemed admitted as a result of his failure to file an answer to the Charges, on April 4, 2012, a Panel of the Business Conduct Committee found that Rodriguez failed to pay an arbitration award against him in the amount of $13,450. Additionally, Rodriguez failed to appear at a scheduled staff interview. The Panel found that in so doing, Rodriguez is guilty of violating Legacy CBOT Rules 618 and 432.L1.

       

      PENALTY:

      The Panel ordered that Rodriguez pay the arbitration award in the amount of $13,450 and fined Rodriguez $50,000. The Panel also barred Rodriguez from applying for membership in any CME Group Exchange, associating with or being employed by any CME Group Exchange member or member firm; and barred Rodriguez’s direct and indirect access to any trading floor or electronic trading and clearing platform owned or operated by CME Group from the effective date below until five (5) years after payment of the arbitration award and fine.
