NYMEX RULE VIOLATION: 562. Position Limit Violations (in part)
Any positions in excess of those permitted under the rules of the Exchange shall be deemed position limit violations.
FINDINGS:
Pursuant to an offer of settlement in which LITASCO S.A. (“LITASCO”) neither admitted nor denied the rule violation upon which the penalty is based, on July 22, 2021, a Panel of the New York Mercantile Exchange Business Conduct Committee (“Panel”) found that on trade date October 16, 2020, LITASCO held a long position of 12,123 lots November 2020 Light Sweet Crude Oil Futures (“NOV21 CL”), which was 26.22% over LITASCO’s hedge exemption eligible position limit of 9,605 contracts in NOV21 CL.
The Panel found that as a result, LITASCO violated Rule 562.
PENALTY:
In accordance with the settlement offer, the Panel ordered LITASCO to pay a fine in the amount of $35,000.
