NYMEX RULE VIOLATION: 562. POSITION LIMIT VIOLATIONS
Any positions in excess of those permitted under the rules of the Exchange shall be deemed position limit violations.
FINDINGS:
Pursuant to an offer of settlement Abalioglu Yag Sanayi (“Abalioglu”) presented at a hearing on July 16, 2020, in which Abalioglu neither admitted nor denied the rule violation upon which the penalty is based, a Panel of the New York Mercantile Exchange Business Conduct Committee (“Panel”) found that at the close of business on January 24, 2020, Abalioglu held a futures equivalent position of 1,154.341 long February 2020 Henry Hub Natural Gas Futures position which was 154.341 contracts (15.43%) over the standard position limit in effect for trade dates January 27, 28, and 29, 2020. Abalioglu realized a profit of $32,850.00 by reducing the firm’s excess position.
The Panel found that as a result, Abalioglu violated Rule 562.
PENALTY:
In accordance with the settlement offer, the Panel ordered Abalioglu to pay a fine to the Exchange in the amount of $15,000 and disgorge profits in the amount of $32,850.00.
