NOTICE OF DISCIPLINARY ACTION

CBOT Rule:           930.E. Calls for Performance Bond

                               3.     Clearing members must maintain written records of all performance bond calls issued and satisfied in whole or in part.           

FINDINGS:                  Pursuant to an offer of settlement in which Goldman Sachs & Co. LLC neither admitted nor denied the rule violation upon which the penalty is based, on October 12, 2023, the Clearing House Risk Committee ("CHRC") found that Goldman Sachs & Co. LLC violated CBOT Rule 930.E.3.

PENALTY:      In accordance with the settlement offer, the CHRC imposed a $150,000 fine which the CHRC agreed to waive if no similar violation was found during the next risk based examination. Based on the results of the subsequent risk based examination, the CHRC waived the fine at the June 6, 2024 CHRC meeting.
