Amendment to Exchange Rule 8.12, Effective Date of Decisions
Exchange Rule 8.12 is being amended to delete the requirement for the Exchange to provide the Commodity Futures Trading Commission ("CFTC") with prior notice when a final decision of a Hearing Panel becomes effective. This amendment aligns the Exchange's Rule with the CFTC's requirements under Title 17, Sections 9.11 and 9.12. The Exchange will continue to provide written notice to the Commission when a decision becomes final pursuant to Title 17, Section 9.11. This amendment will be effective March 3, 2008.

Rule 8.12, Effective Date of Decisions

(A) Unless appealed, a decision of a Hearing Panel is the final decision of the Exchange and shall be effective fifteen (15) days after a copy of the written decision has been served upon the Respondent and to the Commission.

(B) Any fine imposed by a Hearing Panel shall be due and payable on the effective date of the decision or on such later date as the Hearing Panel specifies in the written decision.
