NYMEX Division Fee Increase
The New York Mercantile Exchange announces the following fee increases for NYMEX Division Futures and Options. The fee increases (per side) will be effective at the opening of business for trade date January 2, 2008 and are as follows:

NYMEX Division: Open Outcry and CME Globex

Futures: BH, CL, HH, HO, HP, LH, LR, LU, NG, NN, NP, PA, PL, PN, RB, RT, WS

Options: AA, AB, AC, AM, AO, AT, AZ, CD, CH, FA, FB, FC, FM, IA, IB, IC, IE, IM, IZ, JO, KD, LN, LO, OB, OE, OH, ON, OT, OU, OY, PO, RA, RF, RX, WA, WB, WC, WM, WZ, XF, XW, XY, ZA, ZB, ZC, ZM
Increase:
Member: $0.10
Cross Division (Blended): $0.05
Non-Member: No Change
The resulting rates will be as follows:
Member Day: $0.45
Member Overnight: $0.70
Cross Division (Blended): $0.95
Non-Member: $1.45
EFP, EFS, EOO:
Member: $0.70
Cross Division (Blended): $0.95
Non-Member: $1.45
Futures Resulting from Exercise and Assignment:
Member: $0.70
Cross Division (Blended): $0.95
Non-Member: $1.45
NYMEX Division: ClearPort Clearing

Futures: CL, HO, NG, RB
Increase:
Member: $0.10
Cross Division (Blended): $0.05
Non-Member: No Change
The resulting rates will be as follows:
Member: $0.70
Cross Division (Blended): $0.95
Non-Member: $1.45
Futures: BH, RT, WS
Increase:
Member: $0.20
Cross Division (Blended): No Change
Non-Member: No Change
The resulting rates will be as follows:

Please note that all other fees and surcharges will remain unchanged (including EFS Surcharges, Block Trade Surcharges, Deliveries and Exercise notices).

Under NYMEX Bylaw Section 311, any change in fees of any kind for "Core Products" is a "Special Matter." Owners of Class A Memberships thus have fifteen (15) days from the date of this Notice, using the attached form, to submit a petition by owners of at least 82 Class A Memberships requesting a Special Meeting on the fee increase.
