| Confirmation of Exchange Policy on Connectivity to and Accessing Outside Markets from the Exchange Trading Floors |

| The New York Mercantile Exchange (the "Exchange"), on behalf of both the NYMEX and COMEX Divisions, has permitted, through proper application/registration, internet connectivity to persons and firms on the trading floor of each Division who are using the wireless network provided by the Exchange. The Exchange has also allowed persons and firms on the floor to make their own arrangements for internet connectivity, e.g., through use of dedicated connections.
The purpose of this Notice is to confirm the Exchange's existing policy that, in either of the two instances noted above, the Exchange does not prohibit access by persons or firms on the floor to view or place orders on other markets. Instead, it is the specific market outside the Exchange that will determine and permit the degree of access provided to a specific person or firm on a floor here. Please note that such activity must comply with IT Policies and Procedures as may be established by the Exchange. In particular, the Exchange wishes to remind users of the Exchange's wireless network of Notice 302, which was issued on June 7, 2006, and which establishes a wireless bandwidth allocation policy at the Exchange. |
