Offsite Storage
Prior to NYMEX moving to O.N.E., NYMEX/COMEX members had been able to warehouse their trading records via a Commodity Exchange Center ("CEC") account with Pierce Leahy Archives (this account was originally with Vital Archives). The CEC mailroom coordinated the delivery of broker trading records to/from the warehouse and this service was provided at no cost to the members. After the move and the subsequent dissolution of CEC, NYMEX assumed the responsibility of maintaining only records that had been in storage prior to the move. The Exchange contacted the members involved numerous times to determine ownership as well as the appropriate disposition of these records. All these records exceeded archival requirements and most were returned to the appropriate members or destroyed by the Exchange at the members' request. There are still records that have not been claimed and all have exceeded the appropriate retention requirement. The Exchange has determined that it will maintain these records through the end of July 31, 2006, thereafter it will authorize the destruction of these records.
