Commencement of Video Surveillance of the NYMEX and COMEX Trading Floors
As announced in Notice No. 171 from March 28, 2006, video cameras have been installed on both trading floors. The system is completely operative and surveillance (as described below) will commence on Monday, April 17, 2006.

As stated in the prior notice and in informational sessions held on April 3, 2006 regarding video surveillance, the surveillance equipment will be used during, and immediately before and after, regular trading hours, with the approval of either the Senior Vice President of Compliance and Risk Management or the Vice President of Compliance, to monitor areas of the trading floor where activity constituting violations of Exchange Rules is suspected. Recordings will be reviewed by Compliance Staff, and if evidence of suspected rule violations is captured on the recording, the recording will be maintained for a period of at least five years as part of an investigative file. All other recordings will be expunged as the recording media recycles storage capacity to make way for new recordings.

The system will also be used to monitor the entire NYMEX and COMEX trading floors for security purposes during non-trading hours. Security will review these recordings as needed.

The system will not be recording other than as listed.
