| REMINDER: Policy on Clerks in the Pit Area ClearPort® Clearing Transactions |

| In September 2005, copies of NYMEX's Policies and Procedures concerning the Building and Floor were published and distributed. From this document, the Section "Clerks in the Pit Area" on Page 11 states:
"Clerks actively assisting floor brokers with trading are momentarily permitted in the trading ring areas. Clerks lingering or engaged in any other activity in the trading ring areas are subject to Floor Committee disciplinary action." It has come to the attention of the Floor Committee, NYMEX Floor Department and Compliance Staff that in connection with soliciting prospective parties for ClearPort® Clearing ("CPC") transactions, or confirming contracts allocated to CPC transactions, that some clerks may be violating this policy. All Members and their clerks should be clear regarding the above policy and should take steps to strictly comply with it at the expense of being subject to Floor Committee disciplinary action. |
