Update on Deliveries against the NYMEX Gasoline (HU) Contract
The EPA has indicated that it is planning to issue a final rulemaking next week that is responsive to comments it received on the elimination of the oxygen mandate in Reformulated Gasoline (RFG). As you are aware, gasoline deliveries against the NYMEX New York Harbor Gasoline (HU) Contract must comply with EPA requirements for oxygen content.

Although we understand there has been some confusion, we continue to believe that the elimination of the 2% oxygen requirement will be in effect for deliveries against the May HU Gasoline Contract. As previously announced last month in Notice #06-170, beginning effective May 5, 2006, the minimum oxygen requirement for MTBE in RFG will be eliminated. Thereafter, there will be no mandatory requirement for an oxygen additive, such as MTBE, in RFG, and the use of MTBE will become optional for the seller.
