Beginning in January 2006, the Exchange will charge a monthly fee of $2,000 to participate in the NYMEX miNY^TMDesignee Program for NYMEX miNY^TMcrude oil. The miNY^TMDesignee fee will be billed on a monthly basis to each NYMEX Member that has sponsored a miNY Designee. NYMEX Member Designee sponsors will receive the first bill for the month of January 2006 by the end of December.

The 2006 Program will require the NYMEX miNY^TMDesignee to maintain a minimum trading volume requirement of 200 sides a day based on a monthly average after an initial grace period of 60 days. After the initial grace period, if the miNY Designee fails to maintain the average daily volume for two consecutive months, the NYMEX Member’s participation in the miNY^TMDesignee program will be terminated.

The NYMEX miNY^TMDesignee Program will be reassessed on a yearly basis and subject to the terms and conditions set forth by the Exchange.
