Trade Reconciliation Processing — Mandatory Participation and Locator email Process
The following information explains the process we intend to employ in order to process breaks and will give you an overview of the floor procedures that will occur today and tomorrow.


Clearing Member Information

Due to the unavailability of the Trade Transfer function to correct breaks it is necessary to use the expertise of both a Clearing Member break clerk and a clerk knowledgeable in position transfers to clean up a break. In some cases the two functions are performed by the same person, in others two people are required, Whatever your situation is it is required that the appropriate expertise be available now and throughout this evening until released by the exchange. The same holds true for the floor and the staff required to clean up breaks from their end.

In order to provide you with a method to locate people you are trying to contact and to ensure compliance with mandatory attendance and participation a central e-mail address has been set up to assist you.

If you are trying to locate someone and are not successful in contacting them please e-mail nymexcorrections@nymex.com and provide YOUR contact information, i.e. name, e-mail address or telephone number that you are at and the name of the person or firm that you are trying to locate. We will attempt to contact that person and advise them to contact you using the contact information you provided.

Trade Reconciliation Procedures

The following procedures are to be used on Thursday, February 19, 2004:

For problems with Thursday, February 19, 2004 trades entered into the new ClearPort TMS system, use the functions available within the new ClearPort TMS to correct the trade. For example, top day trades may be claimed, corrected, reallocated or voided. These activities should be performed by traders and/or their clerks.

For trade transfers needed between clearing members for trades executed prior to Thursday, February 19, 2004 (ASOF trades), clearing members should verbally agree to the transfer and one of the clearing members should execute a Position Transfer in the new ClearPort TMS to move the position from one clearing member to the other. Once the position transfer request is made, the opposite clearing member must accept that transfer. NOTE: the Trade Transfer function will not be available; the Position Transfer function must be used. To facilitate this procedure, floor traders and their clerks should communicate transfer information to the sending and receiving clearing members.

For problems with Friday, February 20, 2004 trades entered into the old TMS system, use the functions available within old TMS to correct the trade. For example, top day trades may be "pos duped," corrected, reallocated or voided using the old TMS system. These activities should be performed by traders and their clerks.

For trade transfers needed between clearing members for trades executed prior to Friday, February 20, (ASOF trades), clearing members should verbally agree to the transfer and one of the clearing members should execute a Position Transfer in the old TMS system to move the position from one clearing member to the other. Once the position transfer request is made, the opposite clearing member must accept that transfer. To facilitate this procedure, floor traders and their clerks should communicate transfer information to the sending and receiving clearing members.
