| Discontinuation of NYMEX ACCESS® and Registration for the NYMEX ClearPort(sm) Trading System |

| Previously, the Exchange has indicated to the marketplace that the futures contracts currently listed on NYMEX ACCESS®, which generally include all of the futures contracts listed for floor trading on the NYMEX and COMEX divisions, would be migrated over to the new NYMEX ClearPortsm electronic trading platform sometime later this year. At that time, the NYMEX ClearPortsm trading system also will be enhanced to include some of the features and functionality currently available on NYMEX ACCESS®. This notice is intended to serve as an update on the migration project. The Exchange is currently working on enhancements to NYMEX ClearPortsm to support the listing of the additional contracts and to incorporate other enhancements and new functionality. These new features will be discussed in subsequent notices and releases. The Exchange's Board of Directors has not set a date yet for the migration of futures contracts now listed on NYMEX ACCESS® over to the NYMEX ClearPortsm trading platform. However, Exchange members and other market users should be aware that this migration could occur as early as late third quarter (or early fourth quarter) of this year. When the new version of NYMEX ClearPortsm is launched, NYMEX ACCESS® will be shut down and effectively discontinued at that time. Consequently, once the Exchange has set a launch date for the new version of NYMEX ClearPortsm, the Exchange will provide notice that it will be terminating all current NYMEX ACCESS® system user agreements, effective with the launch date set for the new version of the NYMEX ClearPortsm trading platform. There are a number of companies and individuals who are presently registered as "Electronic Traders" for NYMEX ACCESS® who have not yet signed up as "Users" for purposes of the NYMEX ClearPortsm trading system. To prepare for this mass migration of users, the Exchange strongly encourages all current NYMEX ACCESS® system users to register with the Exchange for the NYMEX ClearPortsm trading platform at http://www.nymex.com/markets/ees_regist_process.aspx.
