| Reminder Of Exchange Prohibition Against Clerk Trading e-miNY Contracts |

| NYMEX Rule 6.30(4) and Exchange Rule 8.62(4) prohibit clerks from trading in any Exchange Contract. Further, Exchange Rule 8.62 subjects clerks to the disciplinary jurisdiction of the exchange. NYMEX Rule 6.30(5) states that Members are responsible for the actions of persons they employ on the trading floor. Note that these prohibitions apply to all Exchange contracts, including emiNY contracts traded over the GLOBEX® system. Relevant portions of the rules (which can be found on NYMEX's website) follow: Rule 8.62. CLERK REGISTRATION, TRADING BADGES, ACCESS TO THE TRADING FLOOR AND DISCIPLINARY JURISDICTION (3) A clerk shall be subject to the jurisdiction of the Exchange pursuant to Exchange Rule 8.59. (4) No clerk may trade for himself or any person or entity in any Commodity contract traded on the Exchange. Rule 6.30. ACCESS TO THE TRADING FLOOR (4) No floor employee of a Member may trade in any commodity contract traded on this Exchange either in his own name or in an account in which he has a direct or indirect interest. (5) A Member shall be subject to disciplinary action for any violation of the Rules committed by an employee of such Member. |
