| Change in Recording Systems for Telephone Calls to NACC |

| Please be advised that, effective July 6th, 2001, the Exchange is changing the service provider that records telephone calls made to the NYMEX ACCESS® Control Center (NACC), which will soon be renamed as the Customer Service Center. Following system launch of enymex, this same service provider also will be used for recording calls to the Customer Service Center concerning enymex. Please note that such recordings will only be maintained for 60 days. In this regard, NYMEX Rule 6.27 ("NYMEX PERSONNEL - LIMITATION OF LIABILITY"), which governs actions against the Exchange for alleged negligent actions or failures to act by NACC employees, requires such arbitration claims to be filed within 10 days following the NYMEX ACCESS® trading session during which the negligent action allegedly occurred. |
